The Institute was established by a resolution of the Third Session of the Presidium of the Czechoslovak Academy of Sciences of 30 January 1960 under the name of the Institute of Theoretical Foundations of Chemical Technology of the Czechoslovak Academy of Sciences. In accordance with Section 18(2) of Act No 283/1992 Coll., it became a department of the Czech Academy of Sciences with effect from 31 December 1992. By a resolution of the Academic Council of the CAS of 22 June 1993, the Institute was renamed the Institute of Chemical Process Fundamentals with effect from 1 July 1993. On the basis of Act No 341/2005 Coll., the legal form of the Institute of Chemical Process Fundamentals changed from a state-funded organisation to a public research institution (v. v. i.) on 1 January 2007.

The founder according to Act 341/2005 Coll. is the Academy of Sciences of the Czech Republic.

11. Place, time limit, and method of appeal against the decision of the obliged body, including an explicit indication of the requirements imposed on the applicant in this respect, as well as a description of the procedures and rules to be followed in these activities:

a. Appeal:

The decision of the obliged entity may be appealed in writing within 15 days of the date of delivery of the decision. The appeal shall be delivered to the obliged entity that issued the decision, i.e. the Institute of Chemical Process Fundamentals of the CAS. The obliged entity shall submit the appeal together with the file to the superior authority within 15 days from the date of receipt of the appeal.

b. Complaint against the procedure for handling a request for information:

The applicant may, if the statutory grounds are met, lodge a complaint against the procedure for handling the request for information, in particular, if a decision on refusal of the request has not been issued within 15 days from the date of receipt of the request by the ICPF CAS, or if the information has not been provided to the applicant either at all or only partially, without a decision on refusal having been issued for the remainder of the request. The complaint may be submitted in writing to the ICPF CAS within 30 days of the date of receipt of the notification on the processing of the request or the date of expiry of the time limit for providing the information.

The superior authority shall decide on the complaint within 15 days from the date on which it was submitted to it. Other requests, proposals, and other requests shall be handled in accordance with Act No. 500/2004 Coll., the Administrative Code, and in accordance with the internal regulations of the Institute of Chemical Process Fundamentals of the CAS.

13. description of procedures:

The procedure of the ICPF in dealing with requests, proposals, and other requests from citizens under Act No. 106/1999 Coll., on free access to information:

A. The ICPF shall assess the content of each request submitted and:

a. if the request is incomprehensible, it is not clear from it what information is requested, or it is formulated in too general terms, it shall invite the applicant to specify the request within 7 days of the submission of the request. If the applicant does not specify the request within 30 days from the date of its receipt – the ICPF will discard the request,

b. if the requested information does not relate to the competence of the ICPF, it shall defer the application and communicate this reasoned fact to the applicant within 7 days,

c. provide the requested information within 15 days of receipt of the submission or clarification of the request, in writing, by consulting the file, including the possibility of making a copy, or on storage media.

B. If information is not provided to the applicant in response to an oral request or if the applicant does not consider the information provided orally to be sufficient, the request shall be made in writing.

C. The conditions under which the ICPF is obliged or may refuse the requested information, limit the provision of information or refer to published information are regulated by Act No. 106/1999 Coll.

D. The time limit for providing information may be extended for serious reasons (Section 14(7) of Act No. 106/1999 Coll.), but not more than 10 days.
